Article 1 - Definitions

The following definitions apply in these Terms and Conditions:

Cooling-off period: The period during which the consumer may exercise their right of withdrawal.

Consumer: The natural person who is not acting in the course of a profession or business and who enters into a distance agreement with the entrepreneur.

Day: Calendar day.

Long-term agreement: A distance agreement relating to a series of products and/or services, where the obligation to supply and/or purchase is spread over a period of time.

Durable data carrier: Any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.

Right of withdrawal: The possibility for the consumer to cancel the distance agreement within the cooling-off period.

Entrepreneur: The natural or legal person who offers products and/or services to consumers through distance selling.

Distance agreement: An agreement where, within the framework of a system organised by the entrepreneur for the distance sale of products and/or services, only one or more means of distance communication are used until the conclusion of the agreement.

Means of distance communication: A method that can be used to conclude an agreement without the consumer and entrepreneur being physically present in the same location at the same time.

Terms and Conditions: These Terms and Conditions of the Entrepreneur.

Article 3 - Applicability

These Terms and Conditions apply to all offers, orders, and agreements between the entrepreneur and the consumer.

Article 3 - Applicability

These Terms and Conditions apply to every offer made by the entrepreneur and to every distance agreement and order concluded between the entrepreneur and the consumer.

Before the distance agreement is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate before the distance agreement is concluded that the Terms and Conditions can be viewed at the entrepreneur’s premises and that they will be sent free of charge to the consumer as soon as possible upon request.

If the distance agreement is concluded electronically, and in deviation from the previous paragraph, the text of these Terms and Conditions may be provided electronically to the consumer before the distance agreement is concluded in such a way that the consumer can easily store it on a durable data carrier.

If this is not reasonably possible, the entrepreneur will indicate before the conclusion of the distance agreement where the Terms and Conditions can be accessed electronically and that they will be sent electronically or by another method free of charge upon request.

In the event that, in addition to these Terms and Conditions, specific product or service conditions also apply, the second and third paragraphs apply accordingly. In the event of conflicting Terms and Conditions, the consumer may always rely on the applicable provision that is most favourable to them.

If one or more provisions of these Terms and Conditions are at any time wholly or partially invalid or are cancelled, the agreement and the remaining provisions of these Terms and Conditions will remain in force. The relevant provision will be replaced immediately by mutual agreement with a provision that most closely reflects the intention of the original provision.

Situations that are not covered by these Terms and Conditions must be assessed according to the spirit and intention of these Terms and Conditions.

Any uncertainties regarding the interpretation or content of one or more provisions of these Terms and Conditions must be interpreted according to the spirit and intention of these Terms and Conditions.


Article 4 - The Offer

If an offer has a limited validity period or is subject to certain conditions, this will be explicitly stated in the offer.

The offer is non-binding. The entrepreneur has the right to modify and adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to properly assess the offer.

Obvious mistakes or obvious errors in the offer do not bind the entrepreneur.

All images, specifications, and information in the offer are indicative and cannot be grounds for compensation or cancellation of the agreement.

Product images are a truthful representation of the products offered. However, the entrepreneur cannot guarantee that the colours shown exactly match the actual colours of the products.

Every offer contains sufficient information to make it clear to the consumer what rights and obligations are connected to accepting the offer. This includes, in particular:

  • The price including taxes;
  • Any shipping costs;
  • The way in which the agreement will be concluded and which actions are required;
  • Whether or not the right of withdrawal applies;
  • The method of payment, delivery, and execution of the agreement;
  • The period for accepting the offer, or the period during which the entrepreneur guarantees the price;
  • The rate for distance communication if the costs of using the means of communication are calculated differently from the standard basic rate;
  • Whether the agreement will be archived after conclusion and, if so, how it can be accessed by the consumer;
  • How the consumer can check and correct the information provided by them before concluding the agreement;
  • Any other languages in which the agreement can be concluded;
  • The codes of conduct to which the entrepreneur is subject and how the consumer can access these electronically;
  • The minimum duration of the distance agreement in case of an extended transaction;
  • Available sizes, colours, and types of materials (optional).

Article 5 - The Agreement

The agreement is concluded, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and fulfils the conditions set.

If the consumer accepts the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance electronically. Until the receipt of this acceptance has been confirmed by the entrepreneur, the consumer may cancel the agreement.

If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organisational measures to secure the electronic transfer of data and ensure a safe web environment. If the consumer can pay electronically, the entrepreneur will apply appropriate security measures.

Within the limits of the law, the entrepreneur may check whether the consumer can meet their payment obligations, as well as all facts and factors relevant to responsibly entering into the distance agreement. If the entrepreneur has reasonable grounds based on this investigation not to enter into the agreement, they are entitled to refuse an order or request with reasons or attach special conditions to its execution.

The entrepreneur will provide the following information with the product or service, either in writing or in a way that allows the consumer to store it easily on a durable data carrier:

  1. The business address of the entrepreneur where the consumer can submit complaints;
  2. The conditions and procedure for exercising the right of withdrawal, or a clear statement if the right of withdrawal is excluded;
  3. Information regarding warranties and existing after-sales service;
  4. The information referred to in Article 4 paragraph 3 of these Terms and Conditions, unless this information has already been provided before the agreement is executed;
  5. The requirements for cancelling the agreement if the agreement has a duration of more than one year or is indefinite.

For a long-term agreement, the previous paragraph only applies to the first delivery.

Every agreement is entered into subject to the condition of sufficient availability of the relevant products.


Article 6 - Right of Withdrawal

When purchasing products, the consumer has the right to cancel the agreement without providing a reason within 14 days after receiving the products, provided that the products are in their original condition and the labels are unopened.

The cooling-off period starts on the day after the consumer, or a representative designated by the consumer and made known to the entrepreneur in advance, receives the product.

If the consumer exercises their right of withdrawal, they must return the product to the entrepreneur in its original packaging with the labels unopened, following the reasonable and clear instructions provided by the entrepreneur.

If the consumer wishes to exercise the right of withdrawal, they must notify the entrepreneur within 14 days after receiving the product. The consumer must do this through a written message or email.

After notifying the entrepreneur, the consumer must return the product within 14 days.

The consumer must provide proof that the delivered goods were returned on time, for example by providing proof of shipment.

If the consumer has not notified the entrepreneur within the applicable deadlines that they wish to exercise their right of withdrawal, or has not returned the product, the purchase becomes final.

The risk of damage and/or loss of products remains with the entrepreneur until the moment of delivery to the consumer or to a representative designated in advance by the consumer and made known to the entrepreneur, unless explicitly agreed otherwise.

Article 12 - Payment

Unless another payment date has been agreed, amounts owed by the consumer must be paid within 7 working days after the cooling-off period begins, as referred to in Article 6 paragraph 1.

In the case of an agreement for the provision of a service, this period begins after the consumer has received confirmation of the agreement.

The consumer has the obligation to immediately report any inaccuracies in the payment details provided or stated to the entrepreneur.

In the event of non-payment by the consumer, the entrepreneur has the right, subject to legal limitations, to charge the reasonable costs that were communicated to the consumer in advance.


Article 13 - Complaints

Complaints regarding the performance of the agreement must be submitted to the entrepreneur within 7 days after the consumer has identified the defects. The complaint must be submitted in a complete and clearly described manner.

Complaints submitted to the entrepreneur will be answered within 14 days from the date of receipt.

If a complaint requires a longer processing time than expected, the entrepreneur will respond within the 14-day period with a confirmation of receipt and an indication of when the consumer can expect a more detailed response.

If the complaint cannot be resolved through mutual agreement, a dispute will arise that is subject to the applicable dispute resolution procedure.

Submitting a complaint does not suspend the obligations of the entrepreneur, unless the entrepreneur indicates otherwise in writing.

If a complaint is found to be justified by the entrepreneur, the entrepreneur will, at their discretion, either replace or repair the delivered products free of charge.


Article 14 - Disputes

Agreements between the entrepreneur and the consumer to which these Terms and Conditions apply are exclusively governed by the laws of the United Kingdom.

These Terms and Conditions also apply if the consumer resides outside the United Kingdom.
